Bundesanstalt fur Finanzdienstleistungsaufsicht (BaFin)

https://www.bafin.de

Germany's financial supervisory authority, BaFin, is one of the largest and most active financial regulators in the European Economic Area. BaFin supervises banks, financial services institutions, insurance companies, and securities trading. It maintains comprehensive registers of authorised entities and publishes regular warnings about unauthorised firms and suspicious investment offerings. For victims of financial fraud involving German entities, German bank accounts, or German residents, BaFin is the primary regulatory authority to engage with.

How to File a Complaint

1

BaFin accepts complaints online through its website at bafin.de. Navigate to the "Complaints & Enquiries" section.

2

Complaints can be submitted in German or English. German-language submissions may be processed more efficiently.

3

Include the entity's full name, website URL, and any registration or company numbers. Provide dates and amounts of transactions.

4

Attach supporting documentation: transaction records, correspondence, screenshots of the platform, and any contracts or terms received.

5

BaFin will acknowledge receipt of the complaint. While BaFin does not act as a dispute resolution body for individual complaints, the information contributes to its supervisory activities and may trigger enforcement action.

6

For banking complaints specifically (e.g., a German bank's failure to process a recall), a separate complaint to the BaFin banking supervision division may be appropriate.

Register & Verification

BaFin maintains a public register of authorised entities accessible at bafin.de. The register includes banks, investment firms, payment institutions, and insurance companies. You can search by entity name, BaFin ID, or LEI number. Entities operating in Germany under a European passport are also listed.

Key Regulations

  • Wertpapierhandelsgesetz (WpHG) -- German Securities Trading Act implementing MiFID II.
  • Kreditwesengesetz (KWG) -- German Banking Act governing credit institutions.
  • Zahlungsdiensteaufsichtsgesetz (ZAG) -- German Payment Services Supervision Act implementing PSD2.
  • Geldwaschegesetz (GwG) -- German Anti-Money Laundering Act implementing AMLD.

Typical Timelines

BaFin typically acknowledges receipt of complaints within 2-4 weeks. The investigation process itself is confidential and may take several months. BaFin does not generally provide individual complainants with updates on the progress of investigations. Publishing a warning about an entity on the BaFin website is one of the fastest public-facing outcomes and can happen within weeks of receiving multiple complaints.
